Welcome to Pedal. We provide our app and website (www.pedaltheapp.com), platforms, tools, and services (together, the "Platform") to you subject to the terms set forth in the Terms of Use (http://pedaltheapp.com/terms.) The Platform is owned and controlled by Cars!Cars! Inc. (d/b/a "Pedal".)

We may update this Agreement at any time. When we do, we will revise the "Revision Date" at the top of this Agreement, and you may view the most recent version at http://pedaltheapp.com/privacy.

By using our Platform you understand and agree that we are providing a platform for you to post content, including photos, text, comments and other materials ("Content,") to the Platform and to share some Content publicly. This means that other Users may search for, see, use, or share any of your Content that you make publicly available through the Platform, consistent with the terms and conditions of this Privacy Policy and our Terms of Use.

We will not rent, sell, or license your information to any third parties, except as specifically set forth in this Privacy Policy and the Terms of Use.

We will collect the information as set forth below for the following purposes:

• · diagnose technical problems and maintain security
• · provide Pedal features and services to you
• · manage, test, and improve the Pedal Platform, website, and services
• · monitor and analyze how you and others use Pedal, which will enable us to create a better user experience for you
• · develop and test new features
• · provide you with information
• · monitor metrics such as number of users, time and frequency of Platform use, and demographics

Instances where we may be required to share your information:

• · Pedal will disclose your information where required to do so: by law, by judicial process, or if we reasonably believe that such action is necessary to comply with civil or criminal law; to enforce our Terms of Use; to protect the security or integrity of our Platform; and to exercise or protect the rights, property, or personal safety of Pedal, Pedal Users, or others.

We collect the following information about you and your Content:

• · Your username, password, and e-mail address when you register for an account.
• · Profile information that you provide for your user profile (e.g., name(s,) picture.)
• · User Content (e.g., words, comments, photos, videos, and other materials) that you post to the Platform, whether you make this Content public or not. When you create a new piece of Content (a "post") we collect the caption, picture or video, audio (if any), comments, and format.
• · Communications between you and Cars!Cars! Inc. For example, we may send you Platform-related emails (e.g., account verification, changes/updates to features, technical and security notices.) We will also collect information related to any reports of abusive Content you make to us.
• · Usage information: When you create a post or someone else shares a post with you, we collect information including the time, date, sender and recipient of the post. We also collect information about the number of posts on the platform, who views the posts, the number of times each user views the post, comments, likes, and any other interactions you have with each post.
• · Device Information: We may collect information about the computer or device you use to access our Platform, including the hardware model, operating system and version, MAC address, unique device identifier, phone number, International Mobile Equipment Identity ("IMEI") and mobile network information. In addition, the Platform may access your device's native image storage applications, with your consent, to facilitate your use of certain features of the Platform. Pedal will not store or copy the information in your storage device images, unless you upload that information and use it to create Content, except as follows:
  • · Logs: Pedal creates and stores information in logs. The logged information includes IP addresses, endpoints you use, and if there are any errors, we store information to diagnose and correct any problems with the Platform.

We use third-party analytics tools to help us measure traffic and usage trends for the Platform. These tools collect information sent by your device or our Platform that assists us in improving the Platform.

We use commercially reasonable safeguards to help keep the information collected through the Platform secure and take reasonable steps (such as requesting a unique password and username) to verify your identity before granting you access to your account. However, Pedal cannot ensure the security of any information you transmit via the Platform or guarantee that information on the Platform may not be accessed, disclosed, altered, or destroyed.

You are responsible for maintaining the secrecy of your unique password and account information. If you believe the Platform's security has been breached, you agree to notify Pedal immediately, via email at info@pedaltheapp.com.

Any information or Content that you voluntarily disclose by posting to the Platform becomes available to the public, as controlled by any applicable privacy settings that you or other users set. If you remove information that you posted to the Platform, copies may remain viewable in cached and archived pages of the Platform, or if other Users or third parties using Pedal have copied or saved that information.

We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.
